PFAS Strategic Roadmap Released by EPA

On October 18, 2022, U.S. Environmental Protection Agency (EPA) Administrator Michael S. Regan announced the agency’s release of the PFAS Strategic Roadmap: EPA’s Commitments to Action 2021-2024. The roadmap lays out the agency’s comprehensive approach to address the unique challenges of PFAS contamination, however, their timeline for completing all of the proposed goals and objectives may be unrealistic.

Solar Technology Applications for Landfills and Brownfields – Part 1

Closed landfills and brownfield sites are increasingly being used to generate electricity through solar power. Although the idea of using otherwise unusable land for generation of clean energy seems to be a no brainer, there are multiple considerations and potential pitfalls which should be explored prior to committing to a landfill or brownfield solar project. Through this multipart series, we will explore the economics, siting requirements, regulatory guidelines, installation process and potential benefits of installing solar systems on landfills and brownfields.

EPA Commits to Rulemaking to Include PFAS Analysis at RCRA Corrective Action Sites

In response to a June 23, 2021 petition from the Governor of New Mexico, U.S. EPA has committed to new Resource Conservation and Recovery Act (RCRA) rulemakings which will require the investigation and possible remediation of per and polyfluorinated substances (PFAS) at RCRA Corrective Action sites across the country. This is likely only the first step in soon to be requirements for sampling, analysis, and possible remediation of PFAS in environmental media nationally, across most regulatory programs.

New Phase I Standard Published

ASTM recently published a revised standard for Phase I Environmental Site Assessments (E1527-21). While there were no momentous changes relative to the previous E1527-13 Standard, the new Standard seeks to normalize expectations during environmental due diligence.

Widely Used EPA Regional Screening Levels Updated in November 2021

EPA recently updated its widely used Regional Screening Levels (RSLs). The updated RSLs (dated November 2021) replace the May 2021 version. The November 2021 update includes RSL changes for over 80 compounds, including new RSLs for three PFAS compounds. Revised WOTUS Proposal Published

On December 7, 2021 the U.S. EPA and the U.S. Department of the Army published a proposed rule to revise the definition of “waters of the United States or WOTUS in the Federal Register. The agencies propose to put back into place the pre-2015 WOTUS definition, updated to reflect consideration of Supreme Court decisions. The publication in the Federal Register officially begins a 60-day comment period on the proposed rule.
