Updates to the Toxic Substances Control Act (TSCA) Confidential Business Information (CBI) Procedural Rule: The EPA announced application updates supporting new requirements under this rule within its electronic reporting site, Central Data Exchange (CDX).  EPA’s final rule on the requirements for Confidential Business Information (CBI) claims under the Toxic Substances Control Act (TSCA), effective from June 2023. It updates CBI requirements, increasing transparency and modernizing reporting and review procedures. Key aspects include clarity on CBI claim scope, narrowed types of information in health and safety studies claimable as CBI, provisions for addressing overly broad CBI claims, expanded electronic reporting requirements, and uniform requirements for providing publicly releasable copies of documents. The rule emphasizes the importance of electronic communication and maintaining accurate contact information for timely delivery of CBI-related notices.
